A landlord and tenant both undertake obligations and responsibilities when they make a lease agreement. The obligations may be set out in the written lease, agreed orally or be established by law. It is important to know what your obligations and responsibilities are when you make a lease agreement because there may be penalties for failing to meet them. Landlord Obligations, Tenant Obligations In some situations the law allows for legal notices to be given between the parties in an effort to remedy the situation. In other cases it is necessary to make an application to court. It is also possible to use court processes to enforce notices and judgments that are not acted upon by the other party. Landlord Remedies, Tenant Remedies No matter what circumstances end a tenancy, the security deposit must be returned to you at the end of a tenancy. Return of Security Deposit There might be occasions when other people besides the tenant are living at the property and the landlord no longer wishes them to be there. Landlord Regaining Possession The owner of a condominium who rents it to you can use the remedies available to a landlord under the Residential Tenancies Act to end your tenancy.
